According the law enforcement regarding the protection and processing of personal data S.C. Carmedia Concept Group S.R.L. hereinafter referred to as "Carmedia" is obliged to manage under security measures the databases created to be used for commercial, marketing and advertising purposes through collecting information from the users by asking them to enter the data required in the application available on www.carmedia-group.com website and to fill with personal data the appropriate fields when signing a contract between Carmedia and a user registered in the databases.

 

 

Users’ consent

 

By entering the information required in the application available on www.carmedia-group.com website and hitting the "Trimite" buttons, each user unequivocally and expressly consents that Carmedia can record and process further the personal data entered.

 

 

Databases access

 

The access to the databases is restricted and each user’s authentication is accomplished by filling the “user" and "password" fields with the appropriate strings. Any attempt to login using a different method than the one described above it is an illegal attempt to access the databases and it will be reported to the authorities. 

 

 

Accuracy, reality and actuality of personal data collected

 

Except for the Carmedia representatives, no other user can access information belonging to another user account using the authentication method described above. Carmedia representatives are forbidden to insert, edit or delete any user account and data belonging to the users registered in the databases.

 

Any person who created a user account by filling the application available on www.carmedia-group.com website and / or by signing a contract with Carmedia is exclusive responsibile for the accuracy, reality and actuality of the personal data submittet into the databases.

 

By filling the application available on www.carmedia-group.com website it is implied that each person who intends to become a registered user in Carmedia databases declared that the identification data are real and correspond to the current situation, knowing that false statements are punishable under the criminal law.

 

 

User rights

 

Each user can enter, modify or delete data from the account created on www.carmedia-group.com website using the authentication method described above. Thus, according to Law no. 677/2001, any person who subscribes to the databases benefits from:

• The right to be informed

• The access right

• The right to interfere over the data

• The right not to be subject to individual decisions

• The right to appeal to Justice.

 

Data collected by filling the application available on www.carmedia-group.com website and other information collected from the contract are held until the user revokes Carmedia access to personal data through exercising the opposition right. Any person who registered information in the databases may preclude processing of the personal data submitted and may request deletion of recorded data.

 

To exercise the rights mentioned above, any registered person can send or present a written request dated and signed to S.C. Carmedia Concept Group S.R.L. headquarter in Voluntari, Ilfov County, 10 Bucuresti Nord Road, O23 building, 6th floor.

 

 

Type of personal data collected

 

Carmedia collects through the application available on www.carmedia-group.com website for commercial, marketing and advertising purposes the following information:

• name and surname

• birthday

• phone / fax

• address (home / residence)

• e-mail

• profession

• data regarding the owned assets

• habits / preferences / behavior

• geographic localization data / traffic data

 

All information which have the asterisk distinction mark represented through the sign “*” and are required by Carmedia to be registered in the databases through filling the application are mandatory. If the mentioned fields are left blank Carmedia cannot establish the identity / contact details / eligibility for a user to attend to advertising campaigns and for this reason the account cannot be created using the form available on www.carmedia-group.com website.

 

All information which do not have the asterisk distinction mark represented through the sign “*” and are required by Carmedia to be registered in the databases through filling the application are facultative. The refusal to provide this information does not interfere with the registration process for a user but can be a tiebreaker due the selection process to identify the appropriate drivers to attend to advertising campaigns.

 

Through www.carmedia-group.com website S.C. Carmedia Concept Group S.R.L. does not collect personal data with a special regime. Personal Identification Number (CNP) and serial and number from ID or passport will be used when Carmedia will sign a contract with one of the users who subscribed to the databases.

 

 

Disclosure of personal data to third parties

 

The databases created through collecting information submitted by users through filling the application available on www.carmedia-group.com website may be disclosed to third parties for commercial, marketing and advertising purposes after the databases have been converted into anonymous data.

• Other companies in the same group as the operator

• Services and goods providers.

 

Warranties for revealing personal data to third party:

 

• Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the  processing of personal data and on the free movement of such data;

• Regulation (EC) No 45/2001 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data;

• Law No. 677 of 21st of November 2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data;

• Law No. 682 of 28th November 2001 on the ratification of the Convention on the protection of individuals with regard to automatic processing of personal data, adopted in Strasbourg on the 28th January 1981;

• Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications)

• Order No. 52 of 18 April 2002 on approving the minimum safety requirements for personal data processing;

• Law No. 506 of 17 November 2004 concerning the processing of personal data and privacy in electronic communications sector;

• Law No. 102 of 3 May 2005 on the establishment and operation of the National Supervisory Authority for Personal Data Processing;

• Law No. 298 of 18 November 2008 on the retention of the data generated or processed by electronic communications providers which are destined to the public or of public communications networks, and to amend Law No. 506/2004 regarding the processing of personal data and privacy in electronic communications sector;

• Law No. 298 of 18 November 2008 on the data generated or processed by the suppliers of electronic communication services meant for public use or by public communication networks and also to amend Law No.506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector;

• Law No. 238 of 10 June 2009 regulating the processing of personal data to structures / units of the Ministry of Administration and Interior in the activities of prevention, investigation and combating of crime, and insurance and maintenance of public order;

• The Implementation Convention of the Schengen Agreement - art. 102-118 - the protection of the personal data in S.I.S. and art. 126-130 - the protection of personal data.

 

The databases will not be transferred abroad.
